Appellant is a tenant of the lower floor of a brick building in the City of Vicksburg. Appellee 'owns and occupies an adjoining three-story brick building. On April 6, 1944, appellee’s building collapsed and fell upon the building of appellant causing considerable damage. Plaintiff sued upon four counts, alleging faulty and negligent construction and maintenance, and presaging reliance upon the doctrine of res ipsa loquitur.
