Plaintiffs are the executors of the will of Eila Haggin McKee, who died in 1936. The testatrix at the time of her death was the owner of two blocks of stock of the Homestake Mining Company. One of these blocks of stock, consisting of 1,000 shares, was placed in the hands of Richard Whitney & Co. (members of the New York Stock Exchange) by the plaintiffs for the purpose of sale. Three hundred shares were sold and the remaining 700 shares were converted into 5,600 shares upon a *251change in par value by the company.
