This matter comes before the Court on defendant’s Special Plea of Sovereign Immunity. Plaintiff Boone filed a Motion for Judgment naming die Norfolk Police Department as the defendant and then filed an amended Motion for Judgment naming the City of Norfolk as the proper defendant The facts as alleged in the Amended Motion for Judgment are as follows.
