Appeal from a judgment of the County Court of Broome County (Smith, J.), rendered July 5, 1995, upon a verdict convicting defendant of the crimes of robbery in the second degree and assault in the second degree.
Defendant and Timothy Platt were both incarcerated in the Broome County Jail. While incarcerated, defendant stole a gold chain and medallion in the possession of Platt and, when Platt attempted to recover his property, defendant hit him repeatedly, fracturing his jaw, nasal bone and maxillary sinus area.
