— Bert L. McCarty, the original plaintiff in this action, was a licensed real-estate salesman in the employ of White & Bollard, Inc. Plaintiff brought this action to recover a real-estate commission of $19,725, payable to his employer, plaintiff’s assignor, as a result of defendant Hagen’s written promise to pay such commission if a sale was “consummated and the property sold.” After lengthy negotiation, McCarty effected an option agreement dated June 23, 1961, between the defendant-respondent R. O. Hagen, as seller, and Charles G. Flanagan, as buyer, for the purchase of a large apartment…
