Jenner Bros., defendants and appellees, on October 15, 1928, entered into , a contract with the state highway commission for excavation and grading on a certain primary state highway in Warren County, designated, as Project P-568. Section 10300 of the 1927 Code provides:
“Contracts for the construction of a public improvement shall, when the contract price equals or exceeds one thousand dollars, be accompanied by a bond, with surety, conditioned for the faithful performance of the contract, and for the fulfillment of such other requirements as may- be provided by law.
