On February 3, 1931, the petitioner, Albert Buss, was employed in a grain elevator owned and operated by the respondent, James Tyler, and the parties were subject to the provisions of the Workmen’s Compensation act. On that date the petitioner suffered an accidental injury which arose out of and in the course of his employment and which was of such a character as to necessitate the amputation of his left leg.
