This case presents error from the district court,of Wagoner county, wherein judgment was rendered in favor of defendant in error, defendant below, in a quo warranto proceeding, involving the offices of county judge and sheriff. Plaintiff, in substance, alleged in his petition that he was a candidate for the office of county judge as nominee of the Republican party; defendant was a candidate for said office as nominee of the Democratic party; that E.
