In a proceeding pursuant to CPLR article 78 to review a determination of the Board of Education of the City of Poughkeepsie School District, dated July 5, 1979, to close the W. W. Smith School, the appeal is from a judgment of the Supreme Court, Dutchess County, dated August 30, 1979, which granted the petition and "annulled and set aside” the determination to close the school. Judgment reversed, on the law, and proceeding dismissed on the merits, without costs or disbursements.
