THIS MATTER is before the Court on the application of the plaintiffs for a preliminary injunction. The plaintiffs seek to enjoin the enforcement of a cease and desist order, issued by the Nebraska Public Service Commission (hereinafter “NPSC” or “Commission”) on April 19, 1983, directing plaintiff Commline Omaha, Inc. (“Comm-line”) to refrain from offering communications services in the State of Nebraska until it applies for, and is granted, a certificate of public convenience and necessity.
