In his bill the plaintiff [Henry Boyd] represents that he holds by assignment the exclusive right, within the county of Hamilton, in this state, to make and sell “a new and useful improvement in the machine for cutting screws on the ends for the rails of bedsteads,” pat-*1097entecl to J. Lindlay [June 20, 1838 (patent No. 797)].
