On the first day of the March term, 1861, of the Madison circuit court, Albert Stagner — who was then indebted greatly *424beyond his means of payment, and expected judgments against him in a few days to the amount of about' $2,000 in suits then pending — went into court as soon as it was opened, and, in fulfillment of an agreement, as we are authorized to presume, confessed a judgment in favor of Owen W.
