The vital issue in this case is the proper construction to be given to the contract which is the foundation of the present suit, and which is set out in the facts above recited. 1. Is it a unilateral contract, as contended, and not enforceable ? 2. If it is not unilateral, but mutual, does it create a lease ? 3. If it creates a lease, what is the meaning of it, and what are the rights of the parties thereunder?
