RAMSEY, Judge.
In this case appellant was charged by information with going into and near a place where people were assembled for public worship, and that he did then and there commit an assault and battery upon one M. S. Grume. He was on this charge thereafter convicted of an aggravated assault and his punishment assessed at a fine of $25.
