The application of Stephen H. Slaughter, to open the decree and to re-commit the case to the commissioner to enable him to prove additional claims against his intestate, was not made till nearly five years after the exhibition of his original bill, nor till after the rendition of the final decree. Besides, the facts stated in the petition were wholly unsupported, except by his *483own affidavit. Under such circumstances we are not prepared to say the Court erred in overruling the motion. '
