The first question presented for consideration by the record is whether the court was authorized to require the city of Jacksonville to pay any part of the deficiency resulting from the verdict of the jury. Section 38 of the act under which the proceeding was had provides for the appointment of a suitable person by the court to make an assessment of the cost of the improvement upon the petitioner and the property benefited.
