(dissenting).—Appellant was convicted for an assault with intent to murder. The punishment for said offense is not less than two nor more than fifteen years confinement in the penitentiary. His punishment was fixed at two years,—the very lowest.

There is no statement of facts on the merits of the case. I take it none was deemed necessary. There is no bill of exceptions and no complaint in any way of the charge of the court. I must, therefore, conclude that without any doubt he had a fair and impartial trial and the evidence established his guilt. The twelve jurors found that he was guilty…
