I. INTRODUCTION
The plaintiff, Ovis Ray Baxter, brought this action to obtain judicial review of a final decision of the Secretary of Health and Human Services (“the Secretary”) which denied the plaintiff’s claim for a period of disability and disability insurance benefits (“the Title II claims”) and supplemental security income (“SSI” or “the Title XVI claim”) under sections 216(i), 223, and 1614(a)(3) of the Social Security Act (“the Act”), 42 U.S.C.A. §§ 416(i), 423, and 1382c(a)(3) (West 1974 & Supp. 1975-1980).
