This action was brought by appellee to recover a penalty of $2,000 against appellant under the provisions of an amendment to article 5475 of the Revised Civil Statutes of Texas, the amendatory provision of the statute being that enacted by the Thirty-Fourth Legislature of Texas (Vernon’s Ann. Civ. St. Supp. 1918, art. 5475).
