Appellant, Arthur Lees, Jr., brought suit in the superior court of Cook County against appellee, Chicago and North Western Railway Company, under the Federal Employers’ Liability Act to recover damages for injuries alleged to have been sustained by him in connection with the installation of a protecting cluster of piling adjacent to appellee’s right of way over its Illinois River bridge, near Pekin, Illinois.
