The testatrix died September 28, 1897. Her will was executed October 3, 1896, and there were two codicils dated August 14, 1897. The fund for distribution by the court below in this proceeding was a portion of the residuary estate of the testatrix which had been devised to the Pennsylvania Company for Insurances on Lives and Granting Annuities, in trust to invest the same and pay certain annuities out of the income, and the surplus of such income is to be distributed under the following clause of the will: “ From the balance, if anjq of said net income, the trustee…
