Seldom does the impact of pre-equitable distribution case law and a decades-old statute ripple into a 2016 decision and give a judge pause. This case is the exception.

In an earlier decision, this court, considering a motion for collection of unpaid arrears in maintenance, held that under the couple’s separation agreement and a later court order, a former husband (the respondent) was obligated to pay his ex-wife (the petitioner) maintenance on a sliding scale, depending on the amount of his income.
