The defendant, James Flynn, was by information charged in the district court of Oklahoma county, Okla., with the crime of forgery in the second degree; was tried, convicted, and sentenced to serve a term of five years in the penitentiary at McAlester, Okla. The defendant filed his motion for a new trial, which was considered and overruled by the court; and he appeals.
