(dissenting) : This is an action

for the recovery of the possession of two separate tracts of land described in the complaint, and for an accounting of rents and.profits and waste. The action not only involves two separate tracts, but they are claimed in different rights. One of the tracts containing 100 acres, is claimed by the plaintiffs as heirs at law of one Amanda Frady, a daughter of Elizabeth E. Tate, who at one time owned the land, and the other, containing 50 acres, is claimed by the two plaintiffs, Mary V. Hughes and Delilah E. Marlin, daughters of Amanda Frady, and granddaughters of…
