This is an action for a declaratory judgment. On September 3, 1925, the defendants Kaplan and Thompson executed and delivered to the plaintiff a bond, by the terms of which they promised and agreed to pay to the plaintiff the sum of $6,500 one year from date “ with interest thereon at the rate of six per cent *281(6%) per annum, payable semi-annually July 1 and January 1 of each year.” The bond was accompanied by a mortgage on real property. Neither the principal of said indebtedness nor the interest accruing since July 1, 1934, has been paid. City taxes are also due and unpaid. The property has…
