The appellant, Mark Randall Johnson, was serving a sentence of life imprisonment for a felony committed in Jefferson County. He was incarcerated at the Staton Annex Correctional Facility in Elmore County. He escaped from Staton, and upon recapture was convicted of escape in the first degree, a violation of § 13A-10-31, Code of Alabama 1975.
