Appeal by the plaintiff, Mary W. Levett, from a determination of the Appellate Term of the Supreme Court, First Department, entered in the office of the clerk of the county of New York on the 29th day of March, 1920, affirming, without costs, a judgment of the City Court of the City of New York.

Smith, J.:

The facts are all stipulated. The defendant is a joint stock association consisting of more than seven persons engaged in the transportation o£ trunks, baggage and other articles of personal property. The plaintiff arrived in the Pennsylvania station and went to a representative of the defendant and delivered to him her check for baggage that had come in on the same train, with directions that the same should be delivered to her home, 1 West Seventy-second street.
