Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court at Special Term, entered in Albany County) to review a determination of the Department of Transportation which denied petitioner an exemption from the Transportation Law as an operator of a taxicab service. Petitioner is a corporation supplying various types of transportation services to the general public from its headquarters in Westchester County.
