Appeal from an order of the Supreme Court, Monroe County *1684(William E Eolito, J.), entered August 31, 2010 in a personal injury action. The order denied the motion of defendant Grand Hotel Inter-Continental Faris SNC to dismiss the amended complaint against it.

It is hereby ordered that the order so appealed from is reversed on the law without costs, the motion is granted and the amended complaint against defendant Grand Hotel InterContinental Faris SNC is dismissed.
