Defendants-appellants the Town of Babylon (the “Town”) and Pinelawn Cemetery (“Pinelawn”) appeal from the January 31, 2006 order of the United States District Court for the Eastern District of New York (Seybert, J.) granting a preliminary injunction to plaintiffs-appellees Coastal Distribution, LLC (“Coastal”) and the New York and Atlantic Railway Company (“NYA”), enjoining the Town from enforcing a stop work order that prohibited Coastal from continuing construction on a shed it operated on property owned by Pinelawn but leased to the Long Island Railroad (“LIRR”) and NYA.
