OPINION

FEDERICI, Justice.

This is a criminal action arising in Rio Arriba County. Defendant was charged in the district court with a single felony count of homicide by vehicle while driving under the influence of intoxicating liquor. NMSA 1978, §§ 66-8-101, 102 (Cum.Supp.1982). Defendant was also charged with several misdemeanor traffic offenses in the Rio Arriba Magistrate Court.
