This was a suit instituted by bill in chancery in the Circuit Court of Mason County, by James P. Kilbreth, who sues as' sole surviving partner of the firm Roots & Kilbreth, which was dissolved by the death of the other partner, G. T Roots, deceased. The bill is against the personal representative of G. Y. Roots, and against his widow and “unknown heirs and devisees,” his surviving partners in the firm of Roots & Co., which it seems consisted of A. E. Smith, H. P. Pifer, and G. Y. Roots.
