Appeal from a decision of the Workers’ Compensation Board, filed February 25, 2000, which ruled that an award of workers’ compensation benefits for claimant’s knee injury was not barred by Workers’ Compensation Law § 28.

Claimant sustained a work-related injury to her back in January 1990 and timely filed a claim which resulted in an award of workers’ compensation benefits. In August 1994, claimant fell and, during a September 1994 office visit to the orthopedist who was treating her work-related back condition, she reported pain in her right knee in addition to continuing back…
