On the day set for oral argument of this cause the respondent, appellee here, filed a motion to dismiss the appeal herein for the reason that relator, appellant here, failed to file a bill of exceptions. There is, however, a properly allowed bill of exceptions in the hands of the court and the respondent apparently abandoned her motion during oral argument. Therefore, the motion to dismiss the appeal is overruled.

This appeal on questions of law is from a judgment of the Common Pleas Court of Lawrence County, entered after the sustaining of respondent’s motion for a judgment on the pleadings.
