The bill of complaint in this cause is filed for the purpose of obtaining an account and settlement of partnership transactions between the parties, and was filed in the early part of the year 1886.
The defendant interposed a plea of a former suit and adjudication for the same identical matter between the same parties. Copies of the pleadings in the former suit are attached to and made a part of the plea, from which the identity of the parties and subject-matter appears.
