This süit was commenced before a justice of the peace, and was a prosecution for malicious trespass under section 13, 2 G. & H. 462, which reads thus: “Every person who shall maliciously or mischievously injure, or cause to be injured, any property of another, or any public property, shall be deemed guilty of a malicious trespass, and be fined not exceeding two fold the value of the damage done, to which may be added imprisonment, not exceeding twelve months.” Ott was found guilty and fined, and appealed to said criminal court, and gave the following bond or recognizance for his appearance…
