— On January 4, 1963, in a summary proceeding, defendant was con*181victed of a violation of the Act of June 24, 1939, P. L. 872, sec. 942, 18 PS §4942. The offense is known generally as cruelty to domestic animals.

On April 10, 1963, a second complaint was filed before Justice of the Peace Louise 0. Green. This complaint contained seven counts. The first count charges defendant with wantonly and cruelly illtreating and abusing horses and cows by maintaining said animals in his barn under such unsanitary conditions as to cause the animals great pain and suffering.
