Appellant, a real estate agent, who was plaintiff in the court below, sued appellee to recover commissions for making an exchange and sale of three certain tracts of land which had been listed with him by appellee for said purpose, alleging that appellee had agreed to pay him a commission of 2 1/2 per cent. on the value of the lands to be exchanged and 5 per cent. on the cash payment; that, notwithstanding he procured a purchaser in the person of R. D. Kinney, who was ready, able, and willing to take said land in accordance with the terms of said trade, appellee subsequently sold the land…
