Scott v. State
Court of Appeals of Texas
1Opinion of the Court
OPINION
LATTIMORE, Justice.
This is an appeal by Calvin Scott who was convicted of the offense of burglary of a habitation. TexPenal Code Ann. § 30.02 (Vernon 1989). After finding the enhancement paragraph to be true, the jury assessed punishment at sixty years confinement in the Institutional Division of the Texas Department of Criminal Justice. Scott contends on appeal that: (1) the circumstantial evidence was insufficient to prove that he acted with the requisite intent and (2) the trial court erred in denying his motion for an instructed verdict.
We affirm.
