HENDERSON, Judge.

The appellant was convicted of murder in the first degree, and his punishment assessed at confinement in the penitentiary for life; hence this appeal.

The theory of the State was that deceased Gilbreath (from whom appellant rented land) was killed by appellant because of some differences between them in regard to renting lands for the succeeding year. The State proved threats by appellant against deceased. His body lay in front of appellant’s house not far from a path that led by appellant’s house to deceased’s house.
