Plaintiffs seek a judgment declaring unconstitutional and void certain amendments of the Building Code and the Building Zone Ordinance of the Town of Hempstead enacted July 14, 1959. [See 10 A D 2d 648.]

For the purposes of this trial it is conceded by the defendants that each of the four plaintiffs has been duly chartered by the State Board of Regents pursuant to sections 216 and 217 of the Education Law to conduct a nursery school, kindergarten, and certain elementary grades, that each of the plaintiffs is a school within the traditional meaning of that term, and that each, for varying…
