While the declaration contained thirteen counts, the case was submitted to the jury on the second, sixth, twelfth and thirteenth, but as the defendant concedes that the verdict for the plaintiff was returned upon the second count, only that count, declaring upon the alleged negligence of the acting superintendent under R. L. c. 106, § 71, cl. 2, with an assessment of damages under § 72, is material.
