This is an appeal from a summary judgment. In the court below, Rosedale Partners, Ltd. sought to enforce a 1987 judgment against Michael and Patricia Walters. The Walterses claimed the affirmative defense of novation and moved for summary judgment. The trial court granted the summary judgment and severed this case from the remaining claims.
