Bernsen v. Live Oak Insurance Agency, Inc.
Texas Court of Appeals, 13th District
1Opinion of the Court
OPINION
HINOJOSA, Justice.
This is an appeal from the trial court’s order granting summary judgment in a sworn account suit for unpaid truck insurance premiums. In a single issue, appellant, Leon Bernsen, Jr. (“Bernsen”), contends the trial court erred in granting the motion for summary judgment of appellee, Live Oak Insurance Agency, Inc. (“Live Oak”), because a genuine issue of material fact exists regarding whether he can be held personally hable for the amount due on the account. We reverse and remand.
