Plaintiff in error, Pd Allen,' was indicted by the grand jury of Jackson county for the crime of killing and murdering on June 29, 1940, of one Lonnie Hill. He was found guilty of murder by a jury and sentenced to the penitentiary for a term of fourteen years. He prosecutes the writ of error to this court to review errors of law in the ruling upon evidence by the trial court, and in the giving of certain instructions claimed to be erroneous.
