STAKELY, Justice.

The following proceedings were had in the cause styled Thomas R. Redwine, individually and as administrator with the will annexed et al., v. Walter Redwine et al., in the Circuit Court of Colbert County, in Equity. What is called an ancillary petition was filed by Thomas R. Redwine, both in his individual capacity and as administrator with the will annexed of the estate of Thomas J.
