HAWKINS, Judge.

Appellant was convicted of assault with intent to murder upon one C. T. Plant, and his punishment assessed at five years’ confinement in the penitentiary.

C. T. Plant was connected with the police department in the city of Dallas, and, upon the night this offense is alleged to have been committed, in company with D. C. Stuterville, another member of the police force, was patrolling the resident section of the city. For this purpose they were using an automobile.
