It is appropriate, at the outset, as preliminary to, and basis for proper consideration of the principal question on this appeal, as hereinafter stated, to advert to the following certain provisions of the statutes pertaining to the court in which this action was commenced, and the procedure prescribed for appeals from its judgments in civil actions:
