In this action, the appellee, as plaintiff, sued the appellant, as defendant, to recover damages for an alleged breach of warranty, in the sale, by the appellant to the appellee, of a, certain saw-mill and the fixtures thereof.
The appellee’s complaint contained a single paragraph, in which the appellee alleged, in substance, that, on the 4th day of March, 1874, Silas Hornaday and Jesse Buell made a certain bill of sale and thereby sold and transferred to the appellant, for the consideration of two thousand five hundred dollars, the following property, situate in Cumberland county, Illinois,…
