FAY, Circuit Judge.

The petitioner James R. Endress appeals a federal district court order which denied his petition for a writ of habeas corpus. In the petition, Endress alleged that certain statements he made to a police detective while in police custody were improperly admitted into evidence since they were the product of an illegal interrogation in violation of his fifth and fourteenth amendment rights. In reviewing the habeas petition, the district court applied the § 2254(d) presumption of correctness to certain findings of the Florida appellate court and concluded that Endress’…
